When you first consult with the Arnone Law Team, they will assess your case and provide a quote for legal services. This quote will include all pre-trial proceedings in district and/or circuit court. Flat fee services exclude discovery costs, trial, and appeals. Should the case proceed to trial or is appealed, the client will then have an opportunity to enter into a new flat fee agreement.

Services that are covered under a retainer agreement with a flat fee criminal defense attorney

When Arnone Law’s services are retained, a retainer agreement will be signed by the client that will outline the services provided under the flat fee criminal defense attorney agreement. Some of the services provided under the agreement are the following:

  • Preparation and filing all necessary documents with the court.
  • Following up with the court regarding court dates and notifying client of same.
  • Serving documents on all parties of record.
  • Requesting and reviewing all evidence and discovery.
  • Researching case law.
  • Client meetings and telephone calls.
  • Communications with opposing counsel/prosecuting attorney and court.
  • Attendance at all court hearings.

Discovery expenses. Discovery expenses are fees that are charged by the policing agencies to produce copies of all police reports, in-car videos, booking videos, etc. The client will be billed the actual costs for these expenses.

Trial. The attorney and the client will enter into a new fee agreement that will consider the time that will be needed to prepare for trial and the expected length trial will be conducted on a case-by-case basis.

Appeals. The attorney and the client will enter into a new fee agreement that will consider the time that will be needed to prepare documents for an appeal and appear for oral argument.

Arnone Law’s flat fee is determined on a case-by-case basis. Some of the factors that are used in calculating the flat fee are the actual criminal charge(s) against the client, whether it is a misdemeanor, felony, or federal case, whether the accused has a prior criminal history, and the circumstances of the crime committed.

Does a flat fee criminal defense attorney accept payment plans?

Although with most flat-fee cases the retainer fee must be paid up front, Arnone Law will consider payment plans with a client based upon their ability to pay and the length of the plan. Legal services cannot begin until a fee agreement has been signed and a down payment has been received.
