DRUG CHARGES COURT PROCESS IN MICHIGAN
Drug Charges Court Process in Michigan
If you have been arrested for either misdemeanor or felony drug charges, understanding the drug charges court process is important. It is crucial that you appear for all hearing dates scheduled by the court and follow all the conditions of your bond.
Arraignment and Bond Conditions
At the time of your arraignment before a magistrate or Judge, you will be given bond conditions. Typical bond conditions for drug charges often include no drug and/or alcohol use and random drug and/or alcohol testing.
It is important that you comply with all conditions of your bond. If you violate a condition of your bond, you will be required to appear before the Judge for a hearing where you risk your bond being revoked. If your bond is revoked, you may be incarcerated during the entire pendency of your court case.
Pretrial
Your case will be scheduled for a pretrial hearing typically 30-60 days after you have been charged. This is the most important stage of the drug charges court process. During this time, your attorney will have the opportunity to obtain evidence and reports, interview witnesses, and speak with experts to build a defense for your case. This allows your attorney the opportunity to negotiate with the prosecuting attorney at the time of the pretrial hearing. Hiring an experienced criminal defense attorney who advocates on your behalf is imperative to a successful outcome of your drug charges.
