CASE RESULTS 

Criminal defense attorneys face many challenges and obstacles when representing their clients. When crimes and subsequent court proceedings get the attention of the press, not only does the public look for justice to be served, the prosecuting attorney may give these cases more attention in attempt to “make an example out of” the accused.

The following examples are summaries of just some of the cases he has handled.

CLIENT FACES BANK ROBBERY CHARGES

Original Charge: Robbery
Outcome: Hung Jury.
Summary: Client was put on trial facing three bank robbery charges. During the trial, the client absconded by cutting off his GPS tether and fleeing. Attorney Joe Arnone continued on with the trial with 19 witnesses testifying and 500 pages of documentary and electronic evidence entered. Even though the client absconded, the jury could not reach an anonymous verdict and a mistrial was declared.

CLIENT FACES CHARGES OF VEHICULAR MANSLAUGHTER AND RECKLESS DRIVING CAUSING DEATH

Original Charge: Vehicular manslaughter and reckless driving causing death, both punishable up to 15 years in prison.
Conviction: Moving violation causing death for failure to activate a turn signal, serving less than six months in jail.
Summary: Client was charged with vehicular manslaughter and reckless driving causing death after a tragic accident. The victim died after suffering the injuries when the client drove his pickup truck away from a curb while, unbeknownst to him, the victim was hanging on to it. She died a week later because a blood clot traveled from her punctured lung to her brain.

While the prosecuting attorney’s office and the victim’s family took the position that the client was an abusive boyfriend who maliciously left the victim to die after the incident, Attorney Joe Arnone was busy collecting evidence and proof of his client’s innocence.

The Arnone Law Team was able to engage the services of an expert in accident reconstruction, obtain a copy of the autopsy report, along with other evidentiary evidence. On the day of jury selection, the prosecuting attorney’s office offered to dismiss the felony charges in exchange for a plea to the misdemeanor charge.

CLIENT FACES CHARGES OF ASSAULT
WITH INTENT TO COMMIT GREAT BODILY HARM

Original Charge: Assault with intent to commit great bodily harm, punishable by up to 10 years in prison
Result: Client was acquitted at trial.
Summary: Client was charged after an altercation outside his place of business. Attorney Joe Arnone was able to establish the defense that the client acted in defense of his son, who was underneath the victim on the ground when he grabbed a 2 x 4, striking the victim multiple times.

CLIENT FACES CHARGE OF SECOND DEGREE MURDER

Original Charge: Second degree murder, punishable up to life in prison
Conviction: Possession of a firearm during the commission of a felony
Summary: Client and the victim got into an verbal altercation. After the victim punched the client, the client retrieved a gun. The victim was shot twice. During trial, Attorney Joe Arnone was able to convince the jury that the client was acting in self defense when the intoxicated victim continued to attack him.

CLIENT FACES FRAUD AND IDENTITY THEFT CHARGES

Original Charge: Fraud and Identity Theft, punishable up to 20 years in prison
Conviction: Plead guilty with a 36-month jail sentence
Summary: Client dubbed the “great imposter” retained the services of Attorney Joe Arnone after being charged with fraud and identity theft. Despite client’s extensive rap sheet that included 46 years of 17 criminal convictions and six arrests, Attorney Arnone was able to negotiate a plea deal that included a maximum of 36 months in jail.
